Terms of service.

Delivery Agreement:

You agree to scheduling your delivery with Old Oak Investments LLC d/b/a Flyway Logistics (“Flyway”) subject to the terms and conditions herein. After you have reviewed, signed and completed this Delivery Agreement, Flyway will contact you via email to confirm your appointment to the email address which you provided at the time of booking. If you need a price quote, you will have to contact Flyway by email at bookflyway@gmail.com, or by phone at 843-284-3122. Your payment is due in full upon receiving the invoice via the email address provided at scheduling. The invoice will be emailed to you after the delivery has been completed. Payments shall be made online via a payment link provided in your invoice with either a credit or debit card through a third party payment provider. If payment is not received in full on your service date then you will be charged a late payment fee of $50.

If you need to cancel your delivery for any reason, you must provide notice to Flyway more than forty-eight (48) hours in advance of your scheduled delivery. Notice of cancellation can provided via email to bookflyway@gmail.com, by phone at 843-284-3122, or directly through the Square application (a link to the application will be provided in your delivery appointment confirmation email). If you fail to provide notice at least 48 hours in advance of your appointment, you will be charged a $50 cancellation fee or 25%, whichever is greater.

Flyway only delivers in state within a hundred (100) mile radius of Charleston, South Carolina. Flyway will not make a delivery outside of the state of South Carolina. Please have the area in your home free and clear of obstructions prior to delivery. Please note the dimensions of the merchandise you have ordered and make sure everything will fit and can be delivered using the entry doors and passages in your home. You must let Flyway know in advance if the delivery to your home might be complicated (3rd floor, narrow staircases, basements, etc). If you fail to do so, Flyway reserves the right to cancel the delivery subject to its cancellation policy above. 

Flyway will make a good faith effort to position your furniture as you would like. However, if delivery to the desired area involves limited maneuverability because of narrow halls, doorways, stairwells, etc., Flyway will not be responsible for damage that might occur to your home or furnishings. If two people cannot reasonably move the item to the desired area and you cannot arrange additional help, delivery will be made to an accessible area. If the merchandise is returned or canceled because it does not fit or cannot be delivered due to inadequate access or due to potential damage to the merchandise or your home, or potential injury to persons, then all delivery charges will still apply and will not be refunded.

Additional services such as assembling, moving or removing your existing furniture are subject to additional fees at Flyway’s discretion. Please contact Flyway if you have questions about additional services.

Flyway is responsible for transporting the furniture safely to your address. However, once the furniture arrives on your property, Flyway is not responsible for damages occurring to the furniture while being moved within your home or for damages to furniture already within your home, entrances, sheet rock, handrails, interior or exterior walls, light fixtures, personal property, etc. You understand that any manufacturer’s warranty and/or warranty provided by the seller is not warranted by Flyway. Flyway provides no warranty, express or implied, including the warranty of merchantability, fitness for a particular purpose, and any warranty against defects in design, materials, or workmanship.

Any claim or action arising in any way out of your contract with Flyway must be brought in any court of competent jurisdiction in Charleston County, South Carolina. In the event of any litigation or claim relating to this Agreement, the prevailing party shall be entitled to an award of reasonable attorneys’ fees and out-of-pocket costs incurred.
